Terms of Service.

The Client has read and acknowledges the Terms of Service before embarking on a sleep plan. This Sleep Coaching Agreement (the “Agreement”) is made and entered between Joanna Bothma (the “Consultant”) and The Client.

1. Purpose of Coaching

The purpose of the coaching relationship is to support the Client in achieving specific goals or outcomes as identified by the Client. The Consultant will use various coaching tools and techniques to support the Client in reaching their goals.

2. Scope of Services

2.1. Services

2.1.1. Description of Services: Consultant agrees to provide sleep consulting services to the Client. These services may include but are not limited to: sleep assessment, sleep training plans, sleep guides, sleep coaching, and ongoing support and guidance. In particular:

  • Sleep consultation
  • WhatsApp or email coaching support
  • Support through Sleep logs
  • Sleep Plan

3. Coaching Goals

The Client and Consultant will jointly develop specific coaching goals at the beginning of the coaching relationship. These goals may be modified as the coaching relationship progresses. The Client acknowledges that results may vary, and that the Consultant cannot guarantee specific outcomes. The consultant will provide guidance and support to the best of their ability.

4. Confidentiality

The Consultant agrees to maintain confidentiality with respect to all information the Client shares during the coaching relationship. The Consultant will not disclose any information to any third party without the Client’s written consent.

5. Fees and Payment

Payment is due before a consultation and sleep plan can be written.

6. Delay in Starting Sleep Plan

If you choose to delay the commencement of the sleep plan for more than 1 month after the consultation, a new questionnaire may be required. Additionally, if the sleep plan necessitates amendments due to the delay, additional fees may apply for the revised plan.

7. Disclaimer

7.1. Consultation is not a Substitute for Medical Advice: The advice provided by the Consultant is not intended as a replacement for medical opinion or treatment. It is designed to address common early childhood sleep issues unrelated to medical conditions.

7.2. Seek Medical Advice: Always seek advice from your doctor or another qualified healthcare practitioner regarding any concerns that may require medical attention or diagnosis before implementing the advice and techniques presented in the Consultant program. Relying on any information the Consultant provides is done at your own risk.

7.3. No Express or Implied Warranties: The Consultant makes no express or implied representations or warranties regarding the consulting services offered.

7.4. Limitation of Liability: The Consultant’s liability, if any, is limited to the consulting fee paid by you. In no event shall the Consultant be liable to you for any other claims, losses, or damages.

7.5. Success Reliant on Implementation: The success of the sleep plan provided by the Consultant is highly dependent on your adherence to the plan. Failure to follow the customized sleep plan, or selective implementation of plan components, may reduce the likelihood of success of your sleep program.

7.6. Confidentiality of Customized Sleep Plan: The customized sleep plan provided by the Consultant is meant for your child and is not meant to be shared with a third party as a sleep plan for another child.

7.7. Responsibility for Changes: Any changes you make to your child’s sleeping or eating routines are your decision. The Consultant may make suggestions for change, but you are responsible for choosing to implement them.

8. Missed Telephone or Virtual Consultations

8.1. Attempted Contact: The Consultant will make reasonable efforts to contact you at the telephone number or other specified method you provide. The Consultant will make up to three attempts to establish contact using reasonable means.

8.2. Cancellation for No Show: If you do not respond to the Consultant’s contact attempts after the third attempt, your scheduled consultation will be considered a “No-Show.” In the event of a No-Show, you will not be eligible for a refund.

9. Safe Sleep Practices

9.1 The Client agrees to follow the safe sleep practices recommended by the AAP (American Academy of Pediatrics) as outlined below. You can see full details on the website link www.healthychildren.org

  • The baby is put on their back to sleep for all naps and overnight.
  • No loose bedding, cot bumpers, or toys within the sleep space. Tight fitted sheets on the mattress is recommended. A sleeping bag/sack is recommended prior to 18 months.
  • No bed sharing.

 

9.2 Bedsharing: If The Client currently bedshares but wishes to purchase a package, The Client will agree that for the duration of the sleep training, The Client will not bedshare and will adhere to the safe sleep practices as written above in 9.1

10. Sleep Log (tracker) Submission Responsibility

10.1. Timely and Accurate Submission: The Client acknowledges that the success of the sleep program is contingent upon the provision of timely and accurate sleep log (daily sleep tracker) information. To facilitate the coaching process and provide the most relevant guidance, it is the Client’s responsibility to submit comprehensive and up-to-date daily sleep logs (daily sleep tracker) as requested by the Consultant.

10.2. Critical to Success: Timely and accurate sleep log (tracker) information is critical to the Client’s success in achieving their sleep goals. The information provided in sleep logs enables the Consultant to tailor the program, make necessary adjustments, and offer timely coaching to address specific challenges or issues.

10.3. Consultant’s Discretion: In the event that the Client fails to submit sleep log (tracker) information in a timely manner, the Consultant reserves the discretion to put the sleep program on hold based on the circumstances. This temporary suspension allows the Consultant to assess and respond effectively when comprehensive sleep log information becomes available.

10.4. Client’s Commitment: The Client agrees to actively participate in the sleep program by promptly submitting sleep logs (daily sleep tracker) and other requested information to facilitate their progress toward their sleep goals.

10.5. Effect on Program Duration: It is important to note that putting the program on hold due to delayed or incomplete sleep log (daily sleep tracker) submissions may affect the overall duration of the sleep program, as adjustments and coaching will be based on the information provided.

  • Refunds

11.1. Service Credit for Delayed Consultations: The Consultant understands that unexpected circumstances may arise, such as illness, travel or personal reasons, which may require the Client to delay their consultation. In such cases, the Consultant is committed to accommodating the Client’s needs and ensuring the consultation process aligns with the chosen program. However, it is important to note that any service credit provided for delayed consultations must be used within 6 months from the original purchase date. If the Client does not initiate contact with the Consultant within 6 months, the program will be considered forfeited, and a refund will not be considered.

11.2. Full Refund within 48 hours: If the Client decides to make a purchase and subsequently changes their mind, the Consultant will honor a full refund within 48 hours of the purchase date. The Client is encouraged to contact the Consultant promptly within this time frame if they want to request a refund.

11.3. Refund Requests for Special Circumstances:The Consultant recognizes that various personal situations may arise, which could necessitate a refund outside of the 48-hour window mentioned in section 11.2. In such cases, the Consultant is willing to review each situation on a case-by-case basis and decide on the refund request based on reason and merit. Please note that any refunds granted beyond the initial 48-hour period will be at the sole discretion of the Consultant and will be contingent upon the circumstances presented by the Client.
